Medical Negligence Cases
Examples Of Common Medical Negligence Cases
Hospital staff are under immense pressure and can occasionally make mistakes in their care for patients. As such they cannot always be held responsible for every single mistake, but failure to diagnose and failure to treat are very serious matters and could lead to medical negligence cases.
These two types of cases can be explained as such:
- Failure to diagnose: when the doctor incorrectly diagnoses a condition, illness or disease, or fails to diagnose the correct condition, illness or disease.
- Failure to treat: when the doctor makes a correct diagnosis of the patient’s condition, but fails to provide proper medical treatment for the condition, illness or disease.
Patients, who have been the victims of these types or other medical errors, may be able to file a medical negligence claim against the responsible parties. In order to successfully file a medical negligence case against the doctor, the patient must be able to prove that the doctor violated the acceptable standard of care and as a result the patient was injured.
If the patient died as a result of the healthcare provider’s negligence, the family may be able to bring a wrongful death suit against the doctor and/or the hospital where the error occurred.
Common medical negligence cases include:
- Commonly misdiagnosed treatments and conditions like breast cancer, diabetes, prostate cancer, strokes, bacterial meningitis, appendicitis and tuberculosis.
- Emergency room errors resulting in medical negligence cases like contaminated blood transfusions, delayed treatment, unsanitary conditions, inadequate patient tracking procedures, medication errors and laboratory errors.
If you have been a victim of medical negligence, you have the right to take legal action and pursue compensation for your losses. Successful medical negligence cases may result in compensation for damages including all related medical expenses, lost wages, pain and suffering, or wrongful death.
